Roque says no comment vs calls for ILC to reject his nomination

Presidential Spokesperson on Monday (Sept. 13) said he has nothing to say with regards to calls for the International Law Commission (ILC) to reject his nomination.

“Wala [akong masasabi] kasi desisyon naman ‘yan ng mga estado. Kung papakinggan sila ng mga estado, eh, wala tayong magagawa,” Roque said during a Malacañang public briefing.

“Pero kung ang kanilang dahilan ay dahil sa International Criminal Court (ICC), hindi po lahat ng bansa ay miyembro ng ICC. In fact, karamihan po ng boboto ay hindi nga po sila miyembro ng ICC,” he added.

According to Roque, he is currently in New York for the nomination to be a member of the ILC which is an advisory body to the United Nations.

“Ano ba ho itong International Law Commission? Hindi po ito hukuman, hindi po ito’y trabaho ‘no. Ito po’y tatlumpu’t apat na mga eksperto sa larangan ng international law,” Roque said.

“Ano po ang mandato nitong International Law Commission? Ito po ay iyong tinatawag na codification of customary international law at iyong progressive development of international law,” he added.

Roque said it was important for nominees of the position to be experts on international law.

“Kaya nga po importante na ikaw ay maging eksperto sa larangan ng international law. Ang customary law po kasi, sa ayaw at gusto ng mga bansa, ito po ay binding on them at iyong progressive development naman po, maski hindi pa po siya customary or hindi pa binding, ay dapat ito ay ninanais na maging binding sa lahat ng mga bansa kaya po progressive ang tawag diyan,” Roque said.

Roque said his qualifications make him eligible for the position.

“Now, bagama’t ako po ay nominado ng Pilipinas, iyong paghalal po sa akin ay sa aking indibidwal na kapasidad bilang eksperto sa international law. Ito po ang subject na itinuro ko nang 15 taon sa UP,” he said.

“Ito rin po ang dahilan kung bakit ako ay naging director ng Institute of International Legal Studies sa UP Law Center at kaya naman po tayo nagkaroon ng nominasyon para dito sa International Law Commission dahil noong kailan lamang po tayo po ay tumayo bilang presidente ng Asian Society of International Law, ang asosasyon ng lahat ng dalubhasa sa Asya,” he added.

Meanwhile, Roque, on accusations of him showing “blatant disrespect” to rule of law and human rights, said such claims are “bereft of legal merit.”

“That’s absolutely bereft of legal merit. Kung mayroon iyon, dapat may kaso na ako. In fact, I’m according the people the right to information by relaying correct and accurate information. Iyan po ang dahilan kung bakit tinanggap ko itong trabaho na ito,” Roque said. -PG-rir
