DOF-BOC, DTI impose anti-dumping duties on importation of cement from covered country

Bureau of Customs on December 20, 2021, issued Customs Memorandum Order (CMO) No. 38-2021, imposing provisional anti-dumping duties for specific types of cement imported from Vietnam, pursuant to the Department Administrative Order (DAO) No. 21-07 from the Department of Trade and Industry (DTI) and in view of the directive of Finance Secretary Carlos G. Dominguez.

Based on Republic Act No. 8752 and its Implementing Rules and Regulations (IRR), an “Anti-Dumping Duty” refers to a special duty imposed on the importation of a product into the Philippines at less than its normal value when destined for domestic consumption in the country of export or origin, it being the difference between the export price and the normal value of such product.

DAO No. 21-07 highlighted that the following products – *Ordinary Portland Cement Type 1* (AHTN 2523.29.90) and *Blended Cement Type 1P* (AHTN 2523.90.00) are being dumped, causing material injury to the domestic cement industry.

Thus, provisional anti-dumping duties in the form of cash bond shall be imposed for four (4) months from the date of effectivity of DAO 21-07 on importations of the above mentioned products originating from Vietnam.
