MANILA — Private sector employees who will report to work on Friday which was declared as special non-working holiday in the celebration of Chinese New Year, are entitled to receive additional 30 percent of their daily rate, on the first eight hours of work for that day.
“For work done during the special day, he/she shall be paid an additional 30 percent of his/her daily rate on the first eight hours of work [(Daily rate x 130 percent) + COLA],” the Department of Labor and Employment (DOLE) said in Labor Advisory No. 03.
The DOLE also noted that the “no work, no pay” principle will apply on Friday.
“If the employee did not work, the no “work, no pay” principle shall apply unless there is favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day,” it added.
For those who worked in excess of eight hours (overtime work), the employee shall be paid an additional 30 percent of his/her hourly rate on said day (Hourly rate of the basic daily wage x 130 percent x 130 percent x number of hours worked).
If the employee went to work during the a special days that also falls on his/her rest day, he/she will be getting an additional 50 percent of his/her daily rate on the first eight hours of work [(Daily rate x 150 percent) + COLA].
For work done in excess of eight hours (overtime work) during a special day that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on said day (Hourly rate of the basic daily wage x 150 percent x 130 percent x number of hours worked).
President Rodrigo Duterte issued Proclamation No. 269, declaring Feb. 16 as special (non-working day).
Filipino-Chinese nationals in the country and around the world will celebrate Lunar New Year or Spring Festival on February 19.
