DOLE: Private sector workers to get 30% add’l pay on Election Day

MANILA–— Private sector employees who will report to work on Election Day will receive an additional 30 percent in their daily pay, the Department of Labor and Employment (DOLE) said on Saturday.

In Labor Advisory No. 07, Series of 2019, Labor Secretary Silvestre Bello III said employees working on Monday will be getting additional pay on the said day.

The DOLE released the following pay rules, as a guide to both employers and workers:

For work done during the special non-working holiday, he/she shall be paid an additional 30 percent of his/her daily rate on the first eight hours of work [(basic wage x 130 percent) + COLA].

For work done in excess of eight hours (overtime work), he/she shall be paid an additional 30 percent of his/her hourly rate on the said day [hourly rate of the basic daily wage x 130 percent x 130 percent x number of hours worked].

If an employee works on a special holiday that also falls on his/her rest day, he/she shall be paid an additional 50 percent of his/her daily rate on the first eight hours of work [(basic wage x 150 percent) + COLA].

For overtime work on a special holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on the said day [Hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked].

The DOLE noted that the “no work, no pay policy” will be implemented on Monday.

“If the employee did not work, the ‘no work, no pay’ policy shall apply unless there is another company policy, practice, or collective bargaining agreement (CBA) granting payment on special days,” it added.

In Proclamation No. 719, President Rodrigo Duterte declared May 13 as a special non-working holiday to enable the public to exercise their right to vote during the mid-term local and national elections.

Over 61 million registered voters will be selecting national and local candidates on Election Day.
