The Quezon City People’s Law Enforcement Board (PLEB) has dismissed a policeman for threatening and hitting his neighbors while drunk on several occasions last year in Brgy. Pasong Tamo.
In a four-page decision in Administrative Case Number 20-002, P/Staff Sgt. Audie Biscarra was found guilty of grave misconduct, particularly oppression and conduct unbecoming of a police officer, and was ordered removed from service.
The dismissal carries with it the cancellation of his eligibility, forfeiture of retirement benefits and disqualification for re-employment in any government service.
The case stemmed from the complaint of Vilma Ballao, who cited three incidents where Biscarra threatened and inflicted physical harm on her son.
On May 15, 2020, after having a drinking spree in public without a facemask, Biscarra threatened to harm Jason Ballao, the son of the complainant, before punching him in the face.
The second incident happened two days after, or on May 17, 2020 where a drunken Biscarra shouted and threatened Ballao’s family.
The third incident happened August 20, 2020, where a drunken Biscarra aimed his gun towards a crowd and told them, “Ano papalag ka ba? May atraso ka sa akin.”
After the incident, Biscarra went to Ballao’s house and went after Brylle Ballao and told him “Papatayin kita. Babarilin kita. Ikaw yung sumuntok sa akin noon.”
The QC PLEB ruled in favor of Ballao, noting the complaint was accompanied by written statements of competent witnesses, CCTV footage and Barangay Blotter Entry.
In handing the punishment of dismissal, the PLEB noted that Biscarra was earlier suspended by the NCRPO for being absent without filing a proper notice of leave.
“Let this decision serve as public notice that the PLEB, at least, our QC PLEB, will not shirk of its duty to serve the ordinary citizens in need of the law,” said PLEB Executive Officer Atty. Rafael Calinisan.
For her part, QC Mayor Joy Belmonte praised the PLEB’s unwavering resolve to get rid of bad eggs from the ranks of the PNP.
“Time and again, the Quezon City police have proven that they act with utmost professionalism and integrity. However, we will not tolerate abusive behavior by the police,” Mayor Belmonte said.
