SC junks Calida’s quo warranto petition vs. ABS-CBN

The Supreme Court (SC) has dismissed the quo warranto petition filed by Solicitor General Jose Calida against ABS-CBN Corporation as it has been considered moot and academic.

Since the franchise of ABS-CBN expired on May 4, the High Court said there is no longer any reason to give way for the petition to determine if the network has violated some parts of its franchise.

The SC is yet to discuss the petition of ABS-CBN on July 13. However, a decision has yet to be granted on the TRO and the network would continue to be off the air.

The Palace said it respects the SC decision and will leave it to the petitioner to “decide on his next legal steps.”

“We respect the decision of the High Court, a separate and co-equal branch of government, on the quo warranto case filed against ABS-CBN Corporation,” Presidential Spokesperson Harry Roque said.

“Meanwhile on the issue of renewal of ABS-CBN franchise, we consider this a prerogative of Congress, which is presently deliberating on the matter,” Roque added.

Calida has not yet issued any statement on the matter as of press time.
