Pemberton’s freedom pending without written order on absolute pardon

The Bureau of Corrections (BuCor) is awaiting the written order regarding the absolute pardon granted by President Rodrigo R. Duterte to US Marine Joseph Scott Pemberton before he can be released.

Pemberton’s release papers remain unprocessed as Malacañang has yet to issue the said documents. Pemberton was charged with homicide for the killing of Jennifer Laude, a Filipino transwoman, in 2014.

BuCor Spokesperson Gabriel Chaclag stated that the pardon paper is needed to start the process of the release. Other internal procedures needed for Pemberton’s camp to go through is supposed to be written in there.

A swab test is also required to make sure that Pemberton is negative of COVID-19 before getting out of prison. This is in accordance with the health protocol of the BuCor against the disease.

Department of Justice (DOJ) Undersecretary Markk Perete explained that the Palace is expected to first give the copy of the written order to the DOJ which, in turn, will be forwarded to the BuCor.

However, USec. Perete pointed out that BuCor must initially know if a deportation order has been issued by the Bureau of Immigration (BI) against Pemberton. If a deportation order is in place, Pemberton will have to be transferred to the BI for custody. If not, he will be set free.

Pemberton is also required to apply for a National Bureau of Investigation (NBI) clearance to make sure that he has no other charges.

DOJ Secretary Menardo Guevarra earlier disclosed that he was consulted by the President before deciding on the pardon. – Report from Bea Bernardo
