SC issues TRO vs NCAP implementation

The Supreme Court issued a temporary restraining order (TRO) on Tuesday, Aug. 30, against the implementation of No Contact Apprehension Policy (NCAP) in the National Capital Region (NCR).

In a media briefer, the Supreme Court said the TRO is “effective immediately and until further orders from the Court.”

“The Court also said that apprehensions through the NCAP programs and ordinances related thereto shall be prohibited until further orders from the Court,” it stated.

The Land Transportation Office and all parties acting on its behalf were also enjoined “from giving out motorist information to all local government units, cities, and municipalities enforcing NCAP programs and ordinances.”

The Supreme Court has set the oral arguments for the case on January 24, 2023.

Meanwhile, the Supreme Court-Public Information Office (SC PIO) will create a microsite in the High Court’s website “in connection with the case and where the public may access and view pertinent pleadings.”

It will also post the resolution once it receives an official copy from the Office of the Clerk of Court En Banc.  –ag
