DOJ to challenge decision on Pemberton’s early release

The Department of Justice (DOJ) will file an appeal before the court in Olongapo City next week to challenge the decision on the early release of Lance Cpl. Joseph Pemberton.

“The DOJ will file its own motion for reconsideration next week. We hope that the OSG (Office of the Solicitor General) will join the DOJ in our motion,” Justice Secretary Menardo Guevarra stated.

Guevarra refused to answer the issue concerning the good conduct time allowance (GCTA) granted to Pemberton since it is covered by subjudice rule. The camp of Laude has also filed a motion for reconsideration before the court regarding the U.S. Marine’s release. Pemberton was convicted of homicide for the killing of Filipino transgender woman Jennifer Laude in 2014.
