BIR files tax evasion raps vs. 2 firms

MANILA — The Bureau of Internal Revenue (BIR) filed separate tax evasion complaints before the Department of Justice (DOJ) against two firms for their failure to pay taxes amounting to PHP221 million.

In a statement, BIR said the two firms — specialized construction firm SKI Construction Group, Inc. (SKI) based in Makati, and YN General Services, Inc., last known to be located in Parañaque — were accused of willful failure to pay taxes under the National Revenue Code of 1997.

SKI, which is engaged in general construction work, as well as those in the likes of nuclear, petrochemical, electronics, mass transit, and other “complex” infrastructure endeavors, has failed to pay taxes amounting to more than PHP206.3 million in 2005 and 2010.

On the other hand, YN General Services allegedly has a deficiency tax liability of more than PHP15.1 million in 2008.

Investigation records of BIR-Makati City showed that the two firms had been served the necessary documents, such as requests for presentation of records and the final decision on the disputed assessment.

The BIR said the two companies were repeatedly served notices for the payment of their respective tax deficiencies and still failed to pay or protest the BIR’s findings, making the assessments “final, executory and demandable”.

“The respondents’ obstinate failure and continued refusal to pay their long-overdue deficiency taxes, despite repeated demands, constitute willful failure to pay the taxes due to the government,” the bureau said in statement.
