MANILA — Workers who will report to work on April 18 and 19 will receive twice their regular daily wages as both days have been declared regular holidays, the Department of Labor and Employment (DOLE) said Wednesday.
DOLE Secretary Silvestre Bello III issued pay rules for April 18 (Maundy Thursday) and April 19 (Good Friday) where workers will be getting 200 percent of their salary for each day.
The prescribed payment for a regular holiday:
For work done during the regular holiday, the employee shall be paid 200 percent of his/her regular salary for the first eight hours ([Basic wage + COLA] x 200 percent).
For those who will render overtime work (work done in excess of 8 hours), the worker shall be paid an additional 30 percent of his/her hourly rate (hourly rate of the basic wage x 200 percent x 130 percent x number of hours worked).
If an employee works on a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her basic wage of 200 percent [(Basic wage + COLA) x 200 percent] + [30 percent (Basic wage x 200 percent)].
For overtime work on a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on the said day (hourly rate of the basic wage x 200 percent x 130 percent x 130 percent x number of hours worked).
As for employees who will not report to work, he/she shall be paid 100 percent of his/her salary for days indicated ([Basic wage + COLA] x 100 percent).
On the other hand, Bello said the “no work, no pay” policy will apply on April 20 (Black Saturday) which is a special non-working holiday.
The following pay rules are as follows:
If the employee did not work, the “no work, no pay” policy shall apply unless there is another company policy, practice, or collective bargaining agreement (CBA) granting payment on special days.
For work done during the special non-working holiday, he/she shall be paid an additional 30% of his/her daily rate on the first eight hours of work [(basic wage x 130%) + COLA].
For work done in excess of eight hours (overtime work), he/she shall be paid an additional 30% of his/her hourly rate on the said day [hourly rate of the basic wage x 130% x 130% x number of hours worked].
If an employee works on a special holiday that also falls on his/her rest day, he/she shall be paid an additional 50% of his/her daily rate on the first eight hours of work [(basic wage x 150%) + COLA].
For overtime work on a special holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her hourly rate on the said day [Hourly rate of the basic wage x 150% x 130% x number of hours worked].
Bello issued Labor Advisory No. 05, series of 2019 for the payment of wages for the said holidays pursuant to Proclamation No. 555 signed by President Rodrigo Duterte.
