DOJ considers request to release “low-risk offender” inmates for another week

The Department of Justice (DOJ) is considering the request to release “low-risk offender” inmates amid the coronavirus disease 2019 (COVID-19) pandemic in the Philippines.

According to Secretary Menardo Guevarra, the justice department needs another week to evaluate the “multi-faceted” matter.

“The term ‘low-risk offenders” may have reference to the gravity (or lack of gravity) of the offenses committed or charged or it could refer to the general conduct shown by the person detained.” DOJ Sec. Guevarra points out.

He explains that the Bureau of Jail Management and Penology (BJMP) detainees may be released under court jurisdiction while the Bureau of Correction (BuCor) persons deprived of liberty (PDLs) may be released through Good Conduct Time Allowance (GCTA), parole or executive clemency which will go through a process.

Any result from the study will still be based on the approval of President Rodrigo Duterte.

Meanwhile, the Judicial Reform Initiative has sent a letter to Chief Justice Diosdado Peralta and to DOJ Sec. Guevarra asking to expedite the investigation and assessment of PDL cases since they have a greater chance of contracting the Corona Virus Disease 2019 (COVID-19). – Report from Kenneth Paciente
